Not gonna lie, I've often thought the exact same thing.
I don't know the law, but that would have been my solution. If it wasn't possible perhaps a quick line about why it wasn't possible would have made a difference. But at the end of the day it didn't make to much difference to me. Smoker was one of my Favorites!
